From next year, all employees will be entitled to 10 days of paid family and domestic violence leave in a 12 month period.
The Fair Work Amendment (Paid Family and Domestic Violence Leave) Act 2022 amends the Fair Work Act 2009 (Cth) to provide for 10 days of paid family and domestic violence leave in a 12 month period. This will replace the current annual entitlement of 5 days of unpaid family and domestic violence leave.
This leave will be available to full-time, part-time and casual employees. It will be available up front on each employee’s work anniversary, and will not be accrued on an annual basis.
The new workplace entitlement will be available from 1 February 2023. Small businesses (with 15 or fewer employees) will have an additional 6 months to adjust to the changes, with the new entitlement coming into effect from 1 August 2023.
