Need a family law expert

The Simmons Wolfhagen family law team is acutely aware that going through a separation or divorce can be a highly emotional period for all involved. Our aim is to support you in reaching swift, practical, and beneficial outcomes, whether it involves pre-nuptial agreements, asset division, drafting parenting plans or representation in Court.

Our family lawyers will:

  • Give you clear advice about separation and dividing assets.
  • Guide you through the process so you can keep moving forward.
  • Help develop a parenting arrangement that secures time with your children.
  • Conduct informal negotiations and mediation to avoid going to court.

What type of services do you offer for family law?

Simmons Wolfhagen lawyers specialise in all family law issues including matters relating to:

  • Matrimonial and de-facto property
  • The LGBTQIA+ community
  • Binding Financial Agreements (commonly known as “pre-nuptial” agreements) – at the commencement of a relationship, or during it. We can also assist you to arrange your financial matters in the event of separation occurring in the future
  • Parenting issues, including those where separating parents agree on arrangements and seek to formalise this agreement through Court Orders; disputes over parenting arrangements, especially when a parent is being denied access; cases involving allegations of abuse; and relocation requests
  • Pre-mediation advice
  • Acting for grandparents and other persons significant to the care, welfare and development of a child or children
  • Child Support
  • Surrogacy
  • Family Violence Orders, Police Family Violence Orders and Restraint Orders

What am I entitled to in a separation?

Our expert family and de facto lawyers can conduct informal negotiations and mediation services to help you determine a ‘just and equitable share’ of the matrimonial assets including but not limited to: the family home, businesses, superannuation, bank accounts, personal and other financial possessions.

If mediation fails, our lawyers can represent you in the Federal Circuit Court of Australia and the Family Court of Australia.

What will you do?

Our family lawyers will:

  • Provide clear advice and then act on it – we will do what we say we are going to
  • Negotiate on your behalf, which is often a more cost-effective outcome for you than going to court
  • Assist with child support implications
  • Keep you informed
